EU Takes Portugal to Court Over Immigrant Legal Rights

The European Union has officially started legal action against Portugal because Portugal is denying basic legal rights to immigrants without valid documents.

This is important news for every immigrant living in Portugal right now.

What Happened?

On 4 June 2026, the European Commission sent a formal warning letter to Portugal.

This is called a Letter of Formal Notice — and it is the first step in a legal process known as an infringement procedure.

Portugal now has two months to respond and fix the problem.

What Is Portugal Doing Wrong?

Under EU law, every person — no matter where they come from, and no matter whether they have documents or not — has the right to a free lawyer if they are questioned by police or taken to court.

But Portuguese law works differently.

If a foreigner does not have a valid residence permit, they may not receive legal aid — meaning they may not get a free lawyer when they need one.

The European Commission says this is completely against EU law. The EU directive is clear:

“Access to legal aid must be guaranteed regardless of citizenship or nationality.”

Portugal is also being criticised for a second issue. If someone is arrested in another EU country because Portugal issued an arrest warrant against them — Portuguese law does not clearly guarantee that person a free lawyer either.

The Commission says both of these are violations of EU rules.

Portugal Is Not the Only One

Portugal received the first step — a Letter of Formal Notice.

Bulgaria and Poland received the second step — a more serious warning called a Reasoned Opinion — for similar failures to correctly apply EU rules on legal aid.

This means Portugal still has a chance to fix the problem before things get more serious.

What Happens Next?

Portugal received a Letter of Formal Notice on 4 June 2026.

 If Portugal does not fix the problem within 2 months, the Commission can send a Reasoned Opinion — a more serious warning.

 If Portugal still does not act, the case goes to the European Court of Justice — where Portugal could face financial penalties.

Why Does This Matter for Immigrants in Portugal?

Many immigrants in Portugal are currently waiting for their residence permits to be processed by AIMA — Portugal’s immigration agency.

As of May 2026, there are still 189,000 Manifestação de Interesse cases waiting for a decision.

Many people’s permits have already expired — through no fault of their own. They applied on time and did everything correctly. But AIMA could not process their paperwork in time.

Under Portugal’s current law, if any of these people face a legal situation — a police question, a court case — they may not be entitled to a free lawyer.

This is exactly what the EU is now challenging.

What Should You Do If You Are Affected?

If you are an immigrant in Portugal and your permit has expired or is still being processed:

You still have rights — EU law protects you even when your documents are delayed.

Keep all your AIMA documents safe — your application receipt, confirmation emails, and any reference numbers. These prove you applied legally and are waiting.
